WHAT TO DO AFTER A Car Accident

The Moments After A Crash Are Disorienting. These Steps Protect You And Your Case.

You do not need to have all the answers right now. But what you do in the hours and days after a car accident can significantly affect your health, your financial recovery, and your legal rights.

01.
Check yourself and everyone in the vehicle for injuries.
Your health is the first priority. Call 911 immediately if anyone is hurt. Even if you feel okay, adrenaline and shock can mask serious injuries, such as spinal trauma, internal bleeding, and concussions. Get medical attention as soon as possible.
02.
Call the police.

A police report documents the facts of the accident before anyone has a chance to change their story. It establishes who was present, what was observed, and often who was at fault. Request a copy of the report for your records.

03.
Document the scene.
If it is safe to do so, photograph the damage to all vehicles, the positions of the cars, skid marks, traffic signs, weather conditions, and any visible injuries. Get the names and contact information of witnesses before they leave.
04.
Exchange information, but do not discuss fault.
Get the other driver’s name, license number, insurance information, and vehicle registration. Do not apologize. Do not speculate about what happened. Even a casual statement can later be used to reduce your recovery.
05.
Do not give a recorded statement to the other driver’s insurance company.
Their adjuster may call the same day. They will sound helpful. They are not. Do not provide a recorded statement, estimate your injuries, or discuss a settlement without an attorney present.
06.
Call Rubenstein Law.
The sooner we get involved, the more effectively we can preserve evidence, protect your claim, and position you for the strongest possible outcome. The consultation is free and there is no obligation.

How Much Is My Car Accident Case Worth?
Everyone Wants to Know the Number. Here’s What Goes Into It.

We understand that you are dealing with medical bills, a damaged vehicle, missed work, and real uncertainty about your future. Every car accident case is different; however, here is what we look at when we take on yours:

We understand that you are dealing with medical bills, a damaged vehicle, missed work, and real uncertainty about your future. Every car accident case is different; however, here is what we look at when we take on yours:

Medical expenses
Every bill tied to this accident: emergency care, imaging, surgery, physical therapy, specialist consultations, and any ongoing treatment your injuries require. Current and future costs both count.
Lost income
Paychecks you have missed during recovery and, if your injuries are serious, the reduction in earning capacity going forward. If you cannot return to the same work, that loss is part of your claim.
Pain and suffering
The physical pain of your injuries, the anxiety of recovery, the impact on your daily life, your sleep, your family, and your ability to do the things you did before. These have measurable value.
Property damage
The cost of repairing or replacing your vehicle and any personal property damaged or destroyed in the accident.
Future impact

If your injuries are long-term or permanent, compensation should reflect the life you will be living, not just the bills already on your desk.

Insurance companies are motivated to close your claim fast and cheap. We are motivated to make sure you understand the full value of your case before you accept a single dollar.

Frequently Asked Questions

01.
How long do I have to file a car accident claim?

In Florida, you generally have two years from the date of the accident to file a personal injury lawsuit. However, evidence disappears quickly and medical documentation is time-sensitive. Contact us as soon as possible to protect your claim.

02.
What if the other driver does not have insurance?
You may still be able to recover compensation through your own uninsured motorist (UM) or underinsured motorist (UIM) coverage. Our attorneys investigate every available source of recovery so that the at-fault driver’s insurance status does not leave you without options.
03.
What if I was partially at fault for the accident?
In Florida, you may still recover compensation if you were not more than 50% at fault, although your recovery will be reduced by your percentage of responsibility. We build detailed cases to minimize any fault attributed to you and maximize your recovery.
04.
The insurance company already made me an offer. Should I take it?
Almost certainly not yet. Initial settlement offers are designed to close your claim before you fully understand what it is worth. Once you accept, you cannot go back. Have an attorney evaluate the offer before you sign anything.
05.
What does it cost to hire Rubenstein Law?
